A few things you should know before challenging the validity of a will

Mrs Ambrosia passed away on 10 December 2013 at the age of 93. After her death it is discovered that... she executed a will on 10 June 2013 in terms whereof a recent acquaintance Mrs Nightshade becomes the sole beneficiary of her entire estate. The will also revokes all her preceding wills, including a will dated 1 January 2009 wherein her son, daughter and their respective children are indicated as Mrs Ambrosia’s beneficiaries. Mrs Ambrosia’s health had deteriorated systematically since 2010 and she was very ill at the time of her death. Can her children challenge the new will and if so what must they prove?

The type of trust discussed is accordingly a typical discretionary trust. Curse of the careless testator: Is your will valid?

The importance of a will cannot be overstated. Not only does it provide expression to a deceased person’s last wishes... regarding the division of his/her assets but it can provide financial security for loved ones for years to come. It can thus rightly be said that a will is probably the most important document a person will ever execute. To achieve these aims however, a will must have been validly executed by the testator (the person executing the will). In the absence of a valid will, your loved ones may find themselves faced with the challenge of an invalid or non-existing will, thereby creating uncertainty and anxiety regarding the deceased’s assets as well as the future financial care and well-being of loved ones, exactly the consequences a careful testator wishes to avoid with a proper and valid will.
